END USER LICENSE AGREEMENT

Elephant Trax is licensed to You (End-User) by Thought Spawn LLC (Licensor), for use only under the terms of this License Agreement.

By downloading the Application from the Apple App Store or Google Play Store, and any update thereto (as permitted by this License Agreement), you indicate that you agree to be bound by all the terms and conditions of this License Agreement, and that you accept this License Agreement.

This License Agreement acknowledges that neither Apple nor Google is a party to it. Thought Spawn LLC is solely responsible for the Application and its content.

This License Agreement does not conflict with the latest Apple App Store Terms of Service or Google Play Terms of Service.

1. The Application

Elephant Trax is a mobile software designed for organizing and managing visual inventory storage. It helps users label, store, and locate items conveniently.

2. Scope of License

2.1 You are granted a limited, non-transferable, non-exclusive license to install and use the Application on devices you own or control.

2.2 This license includes updates unless a new license is issued for them.

2.3 You may not reverse engineer, decompile, or modify the Application.

2.4 Licensor reserves the right to change license terms at any time.

3. Technical Requirements

Licensor may update technical requirements at any time as needed.

4. Maintenance and Support

Support will be provided by Licensor directly. Apple and Google do not provide support for this Application.

5. Use of Data

Licensor may access and use your data under its privacy policy:

6. Liability

Licensor is not responsible for data loss due to breaches of this agreement. You are advised to use backup functionality.

7. Warranty

Licensor ensures the Application is malware-free at the time of download. No warranty is provided for modified or improperly used versions.

8. Product Claims

Thought Spawn LLC, not Apple or Google, is responsible for product liability, regulatory compliance, and consumer claims.

9. Legal Compliance

You agree not to use the app in violation of U.S. export laws or on government-restricted lists.

11. Termination

The license will automatically terminate if you violate any terms. You must stop using the app and delete all copies upon termination.

12. Third-Party Terms and Beneficiaries

Apple and Google are third-party beneficiaries under this agreement and may enforce it upon acceptance.

13. Intellectual Property Rights

Any IP claims will be handled solely by Thought Spawn LLC.

14. Applicable Law

This agreement is governed by the laws of the State of Texas, USA.

15. Miscellaneous

If any term is found invalid, it will be replaced with a valid equivalent. Changes must be in writing. There is no guarantee of complete data security.
